Hopkins County Grand Jury Returns Rape, Deceptive Business Practice Indictments

The Hopkins County Grand Jury handed down various indictments this week, including some for charges of rape, strangulation, and fleeing law enforcement.

An indictment against 21-year-old Dakota Posey, of Madisonville, charges him with second-degree rape, use of a minor in a sexual performance, and possession of matter portraying a sexual performance by a minor. The charges come from incidents from October 2, 2014, and April 19, 2025. The case was investigated by the Madisonville Police Department.

An indictment against 48-year-old Matthew Gates, of Evansville, Indiana, charges him with a charge of deceptive business practices and theft by failure to make required disposition of property under $10,000. Those charges stem from December 19 and 23, 2021. The case was investigated by the Hopkins County Sheriff’s Office.

Gates, former owner of Elite Construction Systems, has reportedly faced similar charges in Vanderburgh, Warrick, and Gibson counties in Indiana. The Courier & Press reported in March 2023 that Gates bilked “more than $100,000 from customers and business associates.” They went on to report, “Across all nine of Gates’ remaining criminal cases in southern Indiana, prosecutors accuse him of failing to complete expensive construction projects for which he received some form of compensation, usually in the form of down payments.”

An indictment against 24-year-old Franklin Suttle, of Madisonville, charges him with first-degree strangulation, fourth-degree assault, and intimidating a participant in a legal process. Those charges come from April 3, 2025. The case was investigated by the Madisonville Police Department.

An indictment against 45-year-old Jonathan Ruby, of White Plains, charges him with first and third-degree fleeing or evading police, resisting arrest, being a felon in possession of a firearm, and six various drug charges, theft of identity, and first-degree persistent felony offender.

As WFMW previously reported, Ruby was apprehended in late March after officers received a credible tip that he was in Madisonville’s city limits. His various charges stem from incidents on December 26, 2024, and March 28 and 31, 2025. Kentucky State Police, Hopkins County Sheriff’s Department, and Madisonville Police Department all assisted in the investigation of the case.

Of the remaining 18 indictments handed down this week by the Hopkins County Grand Jury, 13 of them involved various drug charges.
